Terms and Conditions

Version of 25 October 2026. Replaces all previous versions.

These Terms and Conditions (the “Terms”) govern the use of the wchat.info website and of the Wchat services: WhatsApp click-to-chat links, short links, QR codes, visit statistics and API (the “Service”). The Service is provided by Everysoft, registered office Napoli, Italia, VAT number IT09856651212, e-mail info@sendapp.live (“Wchat”, “we”, “us”).

By creating an account, creating a link, buying the Pro plan or using the API you accept these Terms. If you use the Service on behalf of a company or another organisation, you confirm that you have the authority to accept them on its behalf, and “you” then means that company or organisation. If you do not accept the Terms, you may not use the Service.

1. Definitions

  • User: anyone who uses the Service, with or without an account.
  • Consumer: an individual who uses the Service for purposes outside their trade, business, craft or profession.
  • Business User: anyone who uses the Service for their business or profession (companies, professionals, organisations).
  • Link: any WhatsApp click-to-chat link or short link created with the Service, together with its QR code.
  • Visitor: anyone who opens a Link.
  • Content: everything a User enters into the Service, such as phone numbers, pre-filled messages, destination URLs and custom Link names.

2. The Service

2.1. Free plan: free of charge, with an account. It includes up to 3 WhatsApp links, QR codes and statistics for the last 30 days.

2.2. Pro plan: paid, as a monthly or yearly subscription. It includes up to 100 links (WhatsApp and short links), full statistics with geographic areas, and API access. Current features and prices are always shown on the Plans and prices page.

2.3. Links without an account: when available, people without an account can create WhatsApp links from the home page. These links have no statistics and no management area, and the User cannot edit or delete them.

2.4. Statistics: for every visit to a Link we record the date and time, IP address, approximate location derived from the IP address (country, region, city), device type, operating system, browser and referring site. These data are estimates: they depend on information sent by the Visitor's device and on third-party geolocation databases, and may be incomplete or inaccurate.

2.5. No connection with WhatsApp: Wchat is an independent service. It is not affiliated with, sponsored or endorsed by WhatsApp LLC, Meta Platforms, Inc. or any company of their group. “WhatsApp” is a trademark of its respective owners, mentioned only to describe the Service. Click-to-chat links rely on a public WhatsApp feature: if WhatsApp changes, limits or suspends it, the Service may stop working in whole or in part, and this is not a breach by Wchat. You must also comply with WhatsApp's terms of use.

3. Account

3.1. To create an account you must be at least 18 years old and provide true, complete and up-to-date information.

3.2. You are responsible for keeping your password and API keys confidential and for everything that happens with your account. If you suspect unauthorised access, you must change your password immediately, revoke the API keys concerned and tell us at info@sendapp.live.

3.3. You may not transfer your account or create several accounts to get around the limits of a plan.

3.4. You can close your account at any time by writing to info@sendapp.live from the registered e-mail address. Closing the account does not give a right to a refund, except as provided in section 7.

4. Acceptable use and prohibited content

4.1. You alone are responsible for the Content and for how the Links are used: the messages, the destination pages and the way you distribute Links and QR codes. You confirm that you hold all the necessary rights and permissions, including the consent of the owner of the phone number entered.

4.2. You may not use the Service, directly or through the destination pages, for:

  • phishing, fraud, stealing credentials or payment data, or pretending to be another person, company or institution;
  • distributing malware, viruses or any harmful code;
  • sending spam or unsolicited commercial communications, including on WhatsApp;
  • illegal content, including child sexual abuse material, incitement to hatred, terrorism or violence, threats, harassment or defamation;
  • infringing intellectual property rights, privacy or other rights of third parties;
  • selling or promoting illegal products or services, such as drugs, weapons, forged documents, unlicensed gambling or prescription medicines;
  • collecting Visitors' personal data unlawfully or without giving them the information required by law;
  • hiding the final destination of a link in order to get around the security filters of other services.

4.3. You also may not:

  • access the Service by automated means other than the API, get around its technical or plan limits or its security measures, or overload it;
  • decompile the Service or try to obtain its source code, except where the law allows it;
  • resell access to the Service as a stand-alone link creation service, unless agreed in writing with Wchat.

4.4. We may check Links and Content, by automated or manual means, to enforce these Terms and protect Visitors. However, we have no general obligation to monitor Content.

5. Reports, removal and complaints

5.1. Anyone can report a Link that is illegal or breaches these Terms by writing to info@sendapp.live. The report must give the full address of the Link, the reasons why it is considered illegal and, except where the law provides otherwise, the name and e-mail address of the person reporting it, with a statement that the information is accurate. The same address is the single point of contact for authorities and Users under articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). You can write to us in Italian or English.

5.2. We handle reports diligently and within a reasonable time. We may deactivate a Link, remove Content, or restrict or suspend an account if we believe, in good faith, that they break the law or these Terms, or put Visitors, the Service or third parties at risk. In serious or urgent cases, such as phishing, malware or child sexual abuse material, we may act immediately and without notice, and report the matter to the authorities.

5.3. When we take action on one of your Links or on your account, we send you a clear statement of reasons by e-mail, unless the law or an authority forbids it. You can challenge the decision within 6 months by writing to info@sendapp.live: we will review it and reply. Your rights to turn to an out-of-court dispute settlement body or to the courts are not affected.

6. Pro plan: prices, payment, renewal and cancellation

6.1. Prices: prices and currency are shown on the Plans and prices page and on the payment page, which shows the total amount before you confirm, including taxes where applicable. Taxes are applied according to the law of the customer's country.

6.2. Payment: payments are processed by Stripe. Wchat never sees or stores your full card details. By confirming the purchase you authorise the charge for the first period and for the following renewals to the payment method you chose.

6.3. Automatic renewal: the subscription renews automatically at the end of each period for a period of the same length (one month or one year), at the price in force, until you cancel it.

6.4. Cancellation: you can cancel at any time from the Settings page (“Manage subscription”). Cancellation takes effect at the end of the period already paid: until then you keep the Pro plan and nothing else is charged. Except as provided in section 7 or by mandatory law, partially used periods are not refunded.

6.5. Price changes: we may change the renewal price for justified reasons, such as higher costs or new features. We will tell you by e-mail at least 30 days before the renewal to which the new price applies. If you do not accept it, you can cancel before the renewal at no cost.

6.6. Failed payments: if a payment fails, Stripe retries the charge for a few days and you keep the Pro plan in the meantime. If the payment does not succeed, the account goes back to the Free plan.

6.7. Receipts: payment receipts are available on the subscription management page.

7. Consumers' right of withdrawal

7.1. If you are a Consumer resident in the European Union, you have the right to withdraw from the purchase of the Pro plan, without giving any reason, within 14 days of the conclusion of the contract (articles 52 and following of the Italian Consumer Code). To do so, send a clear statement to info@sendapp.live from the registered e-mail address, or use the model form below. It is enough to send your notice before the 14 days have passed.

7.2. When you buy, you expressly ask for the Pro plan to start immediately, that is before the 14 days have passed. If you then withdraw, we refund the amount paid minus the share proportional to the service already provided up to the day you tell us you are withdrawing (article 57(3) of the Italian Consumer Code). The refund is made within 14 days of your notice, with the same payment method used for the purchase and at no cost to you.

7.3. Business Users have no right of withdrawal.

Model withdrawal form (complete and return this form only if you wish to withdraw from the contract)

To: Everysoft, Napoli, Italia, e-mail info@sendapp.live

I hereby give notice that I withdraw from my contract for the supply of the following service: Wchat Pro subscription (monthly / yearly)
Ordered on: …………  ·  Account e-mail: …………
Name of consumer: …………  ·  Address of consumer: …………
Date: …………  ·  Signature (only if this form is sent on paper): …………

8. What happens to Links

8.1. If you go back to the Free plan, because you cancelled or because a payment failed, the Links you already created keep working. However, you cannot create new ones beyond the Free plan limits or edit short links, and you no longer see geographic statistics or history older than 30 days. Visit data are kept and become visible again if you reactivate the Pro plan.

8.2. We undertake to keep Links active for as long as the Service operates. The exceptions are Links deactivated under section 5 and Links you deleted yourself: deleting a Link also permanently deletes its statistics, and from then on shared links and printed QR codes stop working.

8.3. If we decide to discontinue the Service, we will tell you by e-mail at least 90 days in advance. Pro subscriptions paid in advance are refunded for the unused part.

9. API

9.1. The API is included in the Pro plan and lets you connect your software to Wchat as described in the documentation. You may also integrate it into software you offer to your customers. However, you remain responsible for all Links created with your keys and for your customers' compliance with these Terms.

9.2. API keys are personal and confidential. You must keep them on your servers, never put them in web pages or apps distributed to the public, and revoke them immediately if they are compromised.

9.3. The limits of your plan and the request limits stated in the documentation apply. We may change them or release new API versions: for changes that are not backward compatible we will give you at least 30 days' notice, except for urgent security reasons.

9.4. If the Pro plan ends, the keys stop working until the plan is reactivated. We may revoke a key used in breach of these Terms.

10. Personal data

10.1. Your account data: for the data you give us (name, e-mail, billing data) and for the website's technical data, Wchat is the controller, as described in the Privacy policy.

10.2. Data of your Links' Visitors: when a Visitor opens a Link created with your account, you decide why to use the statistics and you are the controller. Wchat processes those data on your behalf as processor, under article 28 of Regulation (EU) 2016/679 (GDPR), on the following terms, which are part of these Terms:

  • subject matter and duration: recording visits and calculating the statistics described in section 2.4, for as long as your account exists;
  • data and data subjects: Visitors' IP address, approximate location, device technical data and referring site;
  • instructions: we process the data only to provide the Service to you, following the instructions you give us by using it, unless the law requires otherwise;
  • confidentiality and security: only authorised persons bound by confidentiality can access the data; we apply appropriate technical and organisational measures, such as encrypted connections, protected access and API keys stored only in hashed form;
  • sub-processors: we use hosting and technical service providers, under contracts that impose equivalent obligations. You authorise us to use them and we may change them, informing you when the change concerns you; you may object on legitimate grounds by closing your account;
  • assistance: we help you, as far as reasonable, to answer Visitors' requests and to meet the security and notification obligations of the GDPR;
  • breaches: we notify you without undue delay if we become aware of a personal data breach that concerns your Links;
  • end of processing: when you delete a Link or close your account, we delete the related statistics, unless the law requires otherwise;
  • audits: on reasonable request we give you the information needed to show compliance with this section.

10.3. It is up to you to inform Visitors about the processing of their data, for example in your privacy notice, and to comply with the applicable laws, including those on marketing and WhatsApp messages.

10.4. For links created without an account, Wchat is the controller of the Visitors' data, as described in the Privacy policy.

10.5. We may use aggregated and anonymous statistical data, which identify neither Users nor Visitors, to operate and improve the Service.

11. Intellectual property

11.1. The Service, software, website, texts, graphics, and the Wchat trademarks and logos belong to Wchat or its licensors. We grant you a limited, non-exclusive, non-transferable and revocable right to use the Service under these Terms. All other rights are reserved.

11.2. The Content remains yours. You grant us only the licence needed to store, process and display it in order to provide the Service, for as long as you use the Service and for the time strictly necessary afterwards.

11.3. If you send us suggestions or ideas to improve the Service, we may use them freely, without any obligation to you.

12. Availability and changes to the Service

12.1. We do our best to keep the Service available and secure, but we cannot guarantee continuous, error-free operation. The Service may be suspended for maintenance, updates, security issues or causes beyond our control: network or supplier failures, cyber attacks, changes made by WhatsApp, orders of the authorities.

12.2. We may update, change or remove features of the Service. If a change significantly reduces the features of the Pro plan you paid for, we will tell you and you may withdraw with a refund of the unused part of the subscription.

13. Warranties

13.1. The Service is provided “as is” and “as available”. To the extent permitted by law, Wchat does not guarantee that the Service is fit for your particular purposes, nor the business results you will achieve, nor the accuracy of the statistics and geolocation.

13.2. If you are a Consumer, the rights the law gives you if the digital service is not in conformity (articles 135-octies and following of the Italian Consumer Code) are not affected. No clause of these Terms limits them.

14. Limitation of liability

14.1. To the extent permitted by law, Wchat is not liable for:

  • indirect or consequential damage, loss of profits, loss of business opportunities or customers;
  • Users' Content, destination pages, and third-party websites and services, including WhatsApp and Stripe;
  • interruptions due to the causes listed in section 12.1;
  • the consequences of unauthorised use of your account or API keys caused by failure to keep the credentials safe.

14.2. To the extent permitted by law, Wchat's total liability to each User for all events in a year does not exceed the amount the User paid to Wchat in the 12 months before the event, or 50 euros if the User only uses the Free plan.

14.3. The limitations in this section do not apply in case of wilful misconduct or gross negligence by Wchat, personal injury, or other cases where the law does not allow liability to be limited. They do not limit Consumers' mandatory rights.

15. Indemnity

To the extent permitted by law, you agree to hold Wchat harmless from third-party claims, damages, penalties and reasonable costs, including legal fees, arising from your Content, the destination pages of your Links or your breach of these Terms or of the law. We will tell you promptly about the claim and may take part in the defence at our own cost. You may not settle a claim in a way that binds Wchat without its written consent.

16. Suspension and termination

16.1. We may suspend or close your account, with the statement of reasons provided in section 5.3, in case of serious or repeated breach of these Terms, unlawful use of the Service, failure to pay, an order of an authority, or a real risk to the security of the Service or of Visitors. In less serious cases we first give you the chance to put things right.

16.2. If we close the account because of your serious breach, no refund is due, except under mandatory law. If we close it for other reasons, we refund the unused part of the subscription.

16.3. The sections that by their nature must survive the closing of the account remain valid afterwards: 4.1, 10, 11, 14, 15, 18 and 19.

17. Changes to the Terms

17.1. We may change these Terms for justified reasons: changes in the law, new features, security needs or changes to the Service. We publish the new version on this page with the new date.

17.2. For changes that make your position significantly worse, we will tell you by e-mail at least 30 days before they take effect. If you do not accept them, you can close your account or cancel your subscription before that date, with a refund of the unused part of the subscription. If you keep using the Service after the changes take effect, the new version applies.

18. Governing law and jurisdiction

18.1. These Terms are governed by Italian law, excluding the Vienna Convention on the International Sale of Goods. If you are a Consumer resident in another country, you keep the protection of the mandatory rules of your country of residence.

18.2. For disputes with Consumers, the court of the place where the Consumer lives or is domiciled has jurisdiction, if it is in Italy. For disputes with Business Users, the court of Napoli has exclusive jurisdiction.

18.3. Before going to court, write to us at info@sendapp.live: we will try to settle the matter amicably. If you are a Consumer, you may also turn to an alternative dispute resolution (ADR) body provided for by the Italian Consumer Code.

19. Final provisions

19.1. These Terms, together with the Privacy policy and the conditions shown at the time of purchase, are the entire agreement between you and Wchat about the Service.

19.2. If a clause is void or ineffective, the others remain valid. The invalid clause is replaced by the valid one closest to its purpose.

19.3. If Wchat does not exercise a right, this does not mean that it waives that right.

19.4. Wchat may transfer these Terms to a company of its group or to whoever acquires the Service, informing you. If you are a Consumer, the transfer may not reduce your guarantees. You may not transfer the Terms without our written consent.

19.5. Communications between you and Wchat take place by e-mail: ours to your account address, yours to info@sendapp.live.

19.6. These Terms are available in several languages. If the versions differ, the Italian version prevails, without prejudice to the mandatory rules protecting Consumers.

20. Specific approval of clauses (Business Users)

Under articles 1341 and 1342 of the Italian Civil Code, Business Users declare that they have read and specifically approve the following clauses: 2.5 (no connection with WhatsApp and consequences of its changes); 4.4 and 5.2 (checks, deactivation of Links and suspension); 6.3 (automatic renewal); 6.4 (no refund for partially used periods); 6.5 (price changes); 9.3 and 9.4 (changes to limits and revocation of API keys); 12 (availability and changes to the Service); 13.1 (exclusion of warranties); 14 (limitation of liability); 15 (indemnity); 16 (suspension and termination); 17 (changes to the Terms); 18.2 (exclusive jurisdiction); 19.4 (transfer of the contract).
